Terms of Service
1. Provider and scope
Emir Kaan Inan, trading as Carelto
Kaiserstraße 242
45699 Herten, Germany
Email: [email protected]
These draft terms cover Carelto accounts, the AI workspace, API and prepaid credits for consumers and business customers. The service description and order information shown when purchasing also matter. These terms are not yet effective; the final version and acceptance process must be completed before publication.
2. Accounts and security
Provide accurate registration details, protect your password and API keys, and notify us if you suspect unauthorised access. Business users must have authority to act for the organisation concerned. Eligibility and minimum-age rules must be reconciled with registration before finalisation.
3. Service and AI results
Carelto provides access to supported AI models through its workspace and API. Model availability, features and usage limits vary. AI results may be inaccurate, incomplete or inappropriate; evaluate them before relying on them. No particular factual accuracy or business outcome is promised. Mandatory rights relating to defective digital products remain unaffected.
4. Your content and permitted use
You retain any rights you hold in submitted content. You authorise the processing necessary to carry out your requests and deliver results, including transmission to the relevant service providers described in the Privacy Policy. You must have the rights and permissions needed for your submissions. No promise is made that generated content is exclusive or free from third-party rights.
Do not use the service unlawfully, infringe others’ rights, distribute malicious software, attempt unauthorised access, or circumvent security and usage limits. Restrictions must be applied proportionately; contact us if you believe your access was restricted in error.
5. Credits and purchases
Paid usage is funded by one-time prepaid credit purchases. There is no automatic subscription renewal merely from buying a credit pack. The checkout must show the total payable price, included credits, payment method and relevant usage terms before you place a paid order. Consumption depends on the model and usage. Free access has separate limits.
Before finalisation, confirm when an order becomes binding, payment confirmation procedures, credit expiry (if any), rules for remaining balances and non-statutory refunds. No expiry, blanket non-refundability or waiver is imposed by this draft.
6. Consumer withdrawal and refunds
Mandatory consumer withdrawal rights and rights concerning non-conforming digital products are preserved. Contact [email protected] about cancellation or a payment problem. A complete withdrawal notice and model form must accompany the final consumer purchase flow. Starting service or supplying digital content early does not automatically remove withdrawal rights; the applicable conditions must be assessed for the actual product and implemented expressly. This draft does not record consent to early performance or acknowledgement of any loss of rights.
7. Suspension and termination
Access may need to be restricted to address fraud, security incidents, legal obligations or serious misuse. Where appropriate and legally permitted, the reason and an opportunity to address the issue should be provided. Statutory rights to terminate and receive applicable refunds remain unaffected. Treatment of unused paid credits following termination requires confirmation before finalisation.
8. Liability
These draft terms do not exclude liability for intent, gross negligence, injury to life, body or health, guarantees, or other liability that cannot legally be excluded. No blanket liability cap is included. Any further allocation of risk must be reviewed for consumer and business contracts separately.
9. Changes and applicable law
Material contractual changes cannot be introduced merely by silently editing this page. The final change process must respect applicable consumer law. German law is intended to apply, without depriving consumers of mandatory protections that apply in their country of habitual residence. No exclusive consumer forum is imposed.
10. Complaints and disputes
Send complaints to [email protected]. Confirm the applicable consumer-dispute-resolution obligations and participation statement before publication. No obsolete EU online-dispute-resolution link is included.
